Indian Penal Code,1860 - Section 304
Reduction in sentence - Parties lived in same locality - There was no previous enmity between the parties - Incident took place in the heat of passion on account of a sudden quarrel unfortunately culminating in the demise of the deceased - Both the accused convicted under Section 304 Part I Indian Penal Code and sentenced to 10 years R.I. each and to pay fine of Rs. 5,000/- - Incident 12 years old - One of the accused was 65 years old - His sentence reduced to 3 years RI - Sentence of other accused reduced to 7 years - The sentence of fine and imprisonment in default of payment thereof will, however, remain unaltered.
