Indian Penal Code,1860  - Section 304-B , Section 498-A

Death of deceased wife due to 75% burn injuries within four months of marriage in matrimonial home - Statement of father of deceased recorded by investigating officer to the effect that his daughter being fed up from her in-laws poured kerosene on herself and finished her life - Material improvement in the statement of father before court who deposed that his daughter told him in hospital that she was caught hold by his husband and brother-in-law and mother-in-law put kerosene oil on her and was set ablaze by the husband - History sheet of hospital where deceased was treated categorically stated that while deceased tried to ignite a gas stove she suddenly caught fine - Such history sheet proved by doctor who prescribed the treatment to the deceased - Letter written by deceased to her parents showed that there was not even a whisper about demand for dowry but the deceased had categorically stated that she had asked for the money and articles on her own - Material improvements by mother and brother of deceased in court in respect to harassment for demand of dowry soon before the death of the deceased - Prosecution failed to rule out the possibility of accidental death and could not establish that there was harassment meted out to the deceased for dowry soon before her death - Conviction of accused set aside.
