Indian Penal Code,1860  - Section 498-A

Cruelty - Unlawful demands driving her to commit suicide - Husband used to compel deceased to sold off her property and to bring money from her parents - Death of deceased took place in matrimonial home but still no family member of deceased informed about her death - Contention of accused that wife died of natural death cannot be accepted - Minor child of accused and deceased who deposed in favour of accused found untrustworthy - Child was not with deceased at the time of her death which was allegedly caused due to stomach ache - Further held - Independent witness proved the fact - Conviction under Section 498-A upheld.

The Code of Criminal Procedure, 1973  - Section 154

Criminal complaint - Delay - Suicide by a woman due to cruelty of her husband - Criminal case filed after 2 months of incident - Delay was properly explained by parents of deceased as under - Husband did not inform parents regarding death and cremation - When parents came to know, they wanted to lodge criminal complaint, but matter was compromised as husband assured that he would transfer some land in favour of his 8 years old daughter and will take care of child properly - Husband/accused subsequently found not taking care of child properly - Criminal complaint was thus lodged after 2 months - Held, Delay fully explained.
