Indian Penal Code,1860  - Section 302 , Section 304-B

Death of wife due to burn injuries in matrimonial home within three and a half months from the date of marriage - Instances of cruelty meted out to the wife by husband - Appellant/husband convicted under Sections 302 and 304B Indian Penal Code - Sentenced to undergo rigorous imprisonment for life for offence of murder - Only evidence adduced by prosecution to substantiate the allegation of murder is that Appellant husband and the deceased wife stayed in the same house - Not sufficient to hold the appellant guilty for murder - However, accusations related to dowry death satisfied - Conviction upheld under Section 304B Indian Penal Code - Custodial sentence of ten years would meet the ends of justice.
