Indian Penal Code,1860  - Section 498-A

Bigamy - Wife left matrimonial home and started living with her father in 1993 - She filed complaint under Section 498 -A in 1997 - No evidence to show that wife was subjected to physical or mental torture after birth of child in 1993 - Husband cannot be convicted under Section 498 -A - For purpose of Section 498 -A it is to be established that that woman has been subjected to cruelty continuously or at least in close proximity of time of lodging the complaint.

Cruelty - Meaning of - Petty quarrels cannot be termed as cruelty - However causing mental torture to the extent that it becomes unbearable may be termed as cruelty.
