Dying declaration - Multiple dying declarations - Conviction on basis of such declarations - Sustainability of - Acquitted of accused primarily on the ground that dying declarations were not reliable - Procedure laid down by police regulations would not render the dying declaration suspicious - First dying declaration was recorded by the doctor at 3 p.m. - Incident took place at 2 p.m. - It was noted by the doctor that the deceased was in a fit condition to make a statement - No material to show that dying declarations were result of tutoring or prompting - Accused husband specifically described the names in all the dying declarations and role played by him - High Court was not justified in directing acquittal of the accused - Appeal against acquittal accepted - Conviction made by Sessions restored.
