Indian Penal Code,1860  - Section 304-B , Section 302

Dowry death - Death took place within 4 years of marriage - Prosecution relied on the unnatural death of deceased within 7 years and the evidence of brother of deceased who said that he saw that accused (husband) was strangulating the deceased - Accused acquitted on following grounds - 1. Demand of dowry not proved. 2. Brother of deceased deposed that he went to his sisters house at 6 a.m on the day of occurrence and saw that accused was strangulating his sister - No took no action to save and came back home - His conduct was unnatural. 3. FIR lodged after 15 hours of incident. 4. Special Report sent Ilaqa Magistrate after 4 days.
