The Hindu Marriage Act, 1955 - Section 13 (1)
Cruelty - Divorce sought by a spouse on ground of cruelty - Persistence in inordinate sexual demand or malpractices by either spouse can be cruelty if it injuries the other spouse - Further held - 1. Even a single act of violence which is of grievous and inexcusable nature satisfies the test of cruelty. 2. It is also possible that a particular conduct may amount to cruelty in one case but the same conduct necessarily may not amount to cruelty due to change of various factors.

Husband seeking divorce on the ground that his wife abused his parents on 'Lohri' festival in presence relatives and neighbours - Causing immense pain to entire family - Both spouses highly qualified - Husband Principal of ITI College and wife working as librarian in a Government Institute - An isolated friction on some occasion like festival of Lohri even in the presence of others cannot be a valid ground for dissolving the marriage.
