conviction and sentence - Appeal against the State had not preferred any appeal against the judgment of the High Court whereunder conviction and sentence awarded to accused Gopal under Section 302 IPC was altered to under Section 304 Part-I IPC - Injuries sustained by the accused persons was not explained by the prosecution - Injuries sustained by injured persons were simple in nature - Conviction of the accused Gopal upheld under Section 304 Part-I IPC but sentence reduced to the period already undergone by him - Appeal partly allowed.
