Unlawful assembly - Common object - Assault and murder by two accused persons - Other four accused prevented the deceased from escaping but did not cause any injury - All the six accused are guilty of offence under Section 302 read with Section 149 Indian Penal Code - The factum of causing injury or not causing injury would not be relevant, where accused is sought to be roped in with the aid of Section 149, IPC.
