Indian Penal Code,1860 - Section 376
Reduction of sentence in rape case - Rape on matron of a hostel by Chawkidar of the hostel - Accused convicted under Section 376, IPC and sentenced him to 7 years RI by trial Court - In Revision High Court reduced the sentence to already undergone (one year) - Order of High Court with regard to reduction of sentence set aside and that of trial Court restored - Held :- (i) Sexual violence is not only an unlawful invasion of the right of privacy and sanctity of a woman but also a serious blow to her honour. (ii) It indelibly leaves a scar on the most cherished possession of a woman i.e. her dignity, honour, reputation and not the least her chastity. (iii) The entire psychology of a woman and pushes her into deep emotional crisis.
