Indian Penal Code,1860 - Section 376
Rape - Consent - Age of Prosecutrix - Prosecution has totally failed to prove beyond reasonable doubt that the girl was less than 16 years of age at the time of the incident - Held that the girl was more than 16 years of age and she was competent to give her consent as held by the High Court - Question of rape does not arise as consensual intercourse has been proved - No ground to interfere with the judgment passed by the High Court - Appeal liable to be dismissed.
