Indian Penal Code,1860  - Section 302

Murder - Single Blow - In substance the evidence on record suggests only one blow given by the appellant on the head of the deceased which appears to have been given with full force - Held that the act on the part of the appellant is covered by Part I of Section 304 IPC - Conviction and sentence under Section 302 IPC, awarded by the trial court and affirmed by the High Court liable to be set aside - Instead, the appellant liable to be convicted under Section 304 Part I, and sentenced to rigorous imprisonment for a period of ten years.
